Article 1 (Application)

These Terms of Use (hereinafter referred to as “Terms”) define the conditions for using the online shop “SHINTARO KONO” (hereinafter referred to as the “Service”), operated by Makership Inc. (hereinafter referred to as the “Company”). All customers (hereinafter referred to as “Users”) who use this Service shall do so in accordance with these Terms.

The Company may establish separate guidelines or policies (hereinafter referred to as “Individual Provisions”). These shall constitute part of these Terms, and in the event of any conflict, the Individual Provisions shall take precedence.

Article 2 (User Registration)

Users may register via the method specified by the Company. The Company may refuse registration in the following cases:

  • The registration contains false information
  • The applicant has previously violated the Terms
  • The Company deems the registration inappropriate

The Company is not obligated to disclose the reason for refusal.

Article 3 (Account Management)

Users are responsible for managing their own account information (ID, password, etc.).

  • Account information must not be transferred, lent, or shared with third parties.
  • If login credentials match, the Company will assume the account is being used by the legitimate User.
  • The Company is not liable for damages caused by unauthorized use of the User's account.

Article 4 (Formation of Sales Contract)

A sales contract is formed when the User completes the purchase and the Company sends an order confirmation email.

Ownership transfers to the User once the product is handed to the shipping carrier.

The Company may cancel the contract in the following situations:

  • Violation of these Terms
  • Delivery failure due to unreachable contact or long absence
  • Other cases where fulfillment is deemed difficult

Payment, shipping, and return policies are governed by separate terms.

Article 5 (Intellectual Property Rights)

All content (including product images, designs, and text) is the property of the Company or rightful owners.

Users are prohibited from:

  • Unauthorized copying, redistribution, modification, or reuse of content
  • Infringing on the Company's rights

Article 6 (Prohibited Actions)

Users must not engage in the following:

  • Violations of law or public order and morals
  • Infringement of rights of the Company or third parties
  • Unauthorized access, spam, or fraud
  • Obstruction of the Service’s operation
  • Other actions deemed inappropriate by the Company

Article 7 (Suspension or Interruption of Service)

The Service may be suspended or interrupted under the following circumstances:

  • System maintenance or updates
  • Force majeure events such as natural disasters or accidents
  • Operational difficulty as determined by the Company

The Company is not liable for any damages resulting from service suspension or interruption.

Article 8 (Usage Restrictions and Account Termination)

The Company may restrict use or delete accounts without prior notice in the following cases:

  • Violation of the Terms
  • False registration information
  • Payment failure
  • Other reasons deemed inappropriate by the Company

The Company is not responsible for any resulting damages.

Article 9 (Disclaimer)

The Company does not guarantee the following:

  • Error- or bug-free operation of the Service
  • Suitability, completeness, or accuracy of products
  • Responsibility for disputes between Users or with third parties

However, if liability limitations are restricted by law, the Company may be liable for foreseeable damages caused by its negligence.

Article 10 (Changes to the Terms)

The Company may modify these Terms at any time. Changes take effect once published on the website. Continued use of the Service implies agreement to the changes.

Article 11 (Handling of Personal Information)

Personal information obtained through the Service will be handled in accordance with the Company’s Privacy Policy.

Article 12 (Governing Law and Jurisdiction)

These Terms shall be governed by Japanese law. In case of disputes, the court having jurisdiction over the Company’s head office shall be the exclusive court of first instance.
